Charges in Elizabeth New Jersey
More criminal and traffic charges are issued in Elizabeth than any other municipality in Union County. Those that land in the Elizabeth Municipal Court are those falling within the grade of a disorderly persons offense. If you were arrested for this category of criminal offense, you generally face up to six (6) months in the county jail, a $1,000 fine, hundreds of dollars in mandatory court assessments, community service, and/or probation. You will also have a record of conviction that may be viewed by anyway performing a criminal background check. The municipal court also has authority to decide motor vehicle violations written within the 13.46 square miles of the city. A ticket or summons for speeding is probably the most common of these charges although the court also presides over Elizabeth DWI charges and other serious traffic infractions.
If you have been charged with an indictable offense, your case will not be heard in the Elizabeth Municipal Court. A crime of the first, second, third or fourth degree fall outside the jurisdiction of the court. Matters of this nature must be referred to the Union County Superior Court, which is also located in Elizabeth, for handling. The penalties for a first degree crime include 10-20 years in prison and a fine of up to $200,000. A second degree crime results in 5-10 years in prison and a maximum fine of $150,000. The penalties for a third degree crime include up to 5 years in prison and a $15,000 fine. The least severe grade is a fourth degree crime and you can be sentenced to up to 18 months in jail and face a fine of up to $10,000.
