Roselle New Jersey Drug Distribution Charge

The majority of Roselle New Jersey drug distribution charges arising out of N.J.S.A. 2C:35-5 which applies to cocaine, heroin, MDMA (a.k.a. Molly, Ecstasy, etc.), LSD, methamphetamine, marijuana and most other Schedule I, II, III, IV & V controlled dangerous substances. In accordance with this law, it is a crime to manufacture, distribute or possess CDS with the intent to distribute without a valid license. The severity of this violation is predicated on the type of drug and quantity as follows:

  • First Degree Crime. Distributing or selling at least five ounces of heroin, MDMA, methamphetamine or cocaine, at least 25 pounds of marijuana, or 100 milligrams or more of LSD is a first degree crime that exposes you to a prison term of 10-20 years and a fine of up to $500,000 ($300,000 for methamphetamine and marijuana).
  • Second Degree Crime. It is a second degree crime punishable by 5-10 years in prison to distribute, sell or possess with intent a quantity of at least a half ounce but less than 5 ounces of cocaine, methamphetamine, heroin or MDMA, between 5 and 25 pounds of marijuana, less than 100 milligrams of LSD, or 100 or more dosage units of a prescription legend drug like Xanax, Oxycodone/Oxycontin, Hydrocodone or another medication.
  • Third Degree Crime. Selling less than a half ounce of heroin, MDMA, cocaine or methamphetamine, between an ounce and 5 pounds of marijuana or 5-99 dosage units of a prescription drug, or any other Schedule I-IV CDS, is a third degree crime that carries 3-5 years in prison and a $75,000 fine (up to $200,000 for prescription drugs & $25,000 for marijuana).
  • Fourth Degree Crime. It is a fourth degree crime to distribute or sell less than an ounce of marijuana, under 5 dosage units of a prescription drug or a Schedule V. The penalties include up to 18 months in prison and a fine of up to $10,000 ($25,000 for marijuana).

The aforesaid penalties are enhanced with additional charges applying if the drug/cds is being distributed or sold in the Roselle within 500 feet of a public park or housing project or in a school zone (i.e. within 1,000 feet of school property).
