The largest number of cases in Linden Municipal Court involve motor vehicle tickets. Some violations occur more often than others including careless driving, reckless driving, speeding and driving while suspended, without insurance or while intoxicated. The court’s jurisdiction also extends to misdemeanor criminal charges. An offense that involves a first, second, third or fourth degree crime cannot be handled by this court and must be referred to the Union County Courthouse for handling.
Do I Need An Attorney?
While an attorney is not required, most criminal charges heard in municipal court carry the possibility of jail and other serious consequences. For example, if you are convicted of possession of marijuana, you are subject to a fine, a DEDR penalty and other assessments that can approach $2,000. In addition, you can be sentenced to up to six (6) months in the County Jail. As if this were not bad enough, there is a mandatory driver’s license suspension of six (6) months to two (2) years that applies to all drug related offenses. This penalty even extends to drug paraphernalia charges and the CDS cases having nothing to do with possession in a motor vehicle.

Why Should You Contact Our Firm About Your Linden Case?
While consumers frequently assume that all lawyers are the same, this is not the case. Some clearly possess more experience than others and we are certainly among this group. The attorneys on our staff have, in fact, been collectively defending criminal charges in Linden for over 100 years. We also happen to employee several former prosecutors who more than know their way around the Courthouse. The firm has a record of avoiding conviction in a high percentage of disorderly persons cases including simple assault harassment, obstructing the administration of law, criminal mischief and disorderly conduct.
What Will Happen If I Am Found Guilty in Linden?
If you are convicted of a disorderly persons offense, you will, as previously stated, be subject to fines, assessments, probation, jail, and/or community service. In addition to these penalties, you will have a criminal record that will follow you for an absolutely minimum of five (5) years from the date you satisfy any and all fines, as well as any period of probation/supervision. At that point, you may apply for expungment provided you otherwise meet the eligibility requirements for this relief (e.g. lack of a criminal record). To avoid the complications with employment, licensing, etc., presented from a record, you need to avoid a conviction. This is where experienced legal counsel can be so important.
How Do I Prepare For Linden Municipal Court?
The first appearance in municipal court is referred to as an arraignment. At an arraignment, you are read your rights, advised of the penalties that apply to your charge(s), and asked to enter a plea by the Judge. If you plead guilty, the result is a conviction for the underlying offense and responsibility to satisfy whatever penalties are imposed. If you plead not guilty, the case will be adjourned for trial. In the interim, you will have the opportunity to review the discovery in the case (e.g. police report, video, laboratory results, etc.), prepare your defense and negotiate with the prosecutor concerning an amendment and/or dismissal of the charge. While this process sounds relatively straight forward, it is both intimidating and complicated for most non-attorneys. In our opinion, the best way to prepare for the process is to hire the best attorney within your budget.
