Possession of marijuana in Clark is guided by N.J.S.A. 2C:35-10. It is a disorderly persons offense to possess 50 grams or less of marijuana in violation of 2C:35-10a(4). The more serious variety of marijuana offense you can face in the Township of Clark is distribution in violation of N.J.S.A. 2C:35-5. If you sell, distribute or possession with intent to distribute 25 pounds or more of marijuana in Clark New Jersey, you face a first degree crime and penalties that include 10-20 years in prison and a fine of up to $300,000. It is a second degree crime to distribute/sell at least 5 pound but less than 25 pounds of marijuana. The penalties for this form of distribution include a fine of up to $150,000 and 5-10 years in prison. Distribution of at least an ounce but less than 5 pounds of marijuana is third degree crime that results in up to 5 years in state prison and a maximum fine of $25,000. Selling less than an ounce of marijuana is a fourth degree crime and can result in your being imprisoned for up to 18 months and fined up to $10,000.
