Harassment Offense in Clark New Jersey
It is a petty disorderly persons offense under N.J.S.A. 2C:33-4 if you are convicted of harassment in the Municipal Court of Clark. Under limited circumstances that are set forth later in this article, an individual may also be found guilty of a fourth degree crime for harassment at the Union County Superior Court which is located in Elizabeth. Someone commits this offense if, with the purpose to harass, they:
a. Makes, or causes to be made, a communication or communications anonymously or at extremely inconvenient hours, or in offensively coarse language, or any other manner likely to cause annoyance or alarm;
b. Subjects another to striking, kicking, shoving, or other offensive touching, or threatens to do so; or
c. Engages in any other course of alarming conduct or of repeatedly committed acts with purpose to alarm or seriously annoy such other person.
The judge of the Clark Municipal Court may impose a fine of up to $500 and up to 30 days in the Union County Jail. If the accused “was on parole or probation as the result of a conviction of any indictable offense” when he/she committed harassment, the violation is a fourth degree crime punishable by a fine of $10,000 and up to 18 months in prison. You should also know that harassment constitutes an act of domestic violence when it is committed against someone protected by the NJ Prevention from Domestic Violence Act. This law provides for issuance of a restraining order to protect a victim of domestic violence.
